Court of Appeals: Cheating twice means no payout


In a controversial ruling, Turkey's Supreme Court of Appeals ruled that a husband cheating on his wife twice does not have to pay compensation to her. According to a news report in the Vatan newspaper, the court, the ultimate judicial authority, issued the verdict ruling out compensation on the grounds that the man cheated on his wife with the same woman.The unidentified wife had filed for divorce from her husband at an Istanbul court, citing irreconcilable differences. She told the court she had forgiven her husband after he cheated on her, but he cheated on her again with the same woman. The wife demanded compensation from the husband, while the husband denied the charge and claimed his wife defamed him. The court rejected the woman's demand of compensation and ordered a divorce. The woman has appealed the ruling.The Supreme Court of Appeals upheld the ruling of the lower court, whose judges said it was not "cheating" if the husband cheated on his wife a second time around the same woman he cheated on her before with. The judges said in the ruling that the wife had already forgiven the husband over his affair with the other woman, and since the husband continued his affair after the act of forgiveness, it was not a separate act of cheating.
